Patna High Court took action against an advocate who is a public prosecutor whose absence resulted in Non-Disposal of over 90 Bail matters. Because of his absence before the court due to which over 90 bail matters could not be disposed of by the court. The Case was Anand Kumar V/S The State of Bihar[Criminal Miscellaneous No. 47273 of 2022]. The Case was presided by Honourable Mr. Justice Sanjeev Prakash Sharma.

Facts of the cases

  1. On December 16, 2022 100 bail matters were listed in front of the bench of Justice sharma.
  2. Only two Public prosecutors were present, namely Shri Ajay kr Jha and Shri Dr. Ajit Kumar has only two cases under them. Rest of the case was under the absent public prosecutor.
  3. The court was disappointed with the absence of a public prosecutor.

Judgment

Expressing disappointment over the absence of the Public prosecutor in charge, the court ordered that 95 bail applications (which remained undisposed due to the absence of the PP concerned) be listed before the Regular Bench on December 20, 2022.
