Intro:
The petitioner, Sumer Singh, aged approximately 75 years and a resident of Village Bavata, Tehsil Sayala, District Jalore, Rajasthan, has filed this writ petition seeking the installation of an electricity connection for Respondent No. 4, Shri Super Foods, Jalroe, represented by Shri Goma Ram, a resident of Village Bavatra. The petitioner claims that the installation should be carried out through a cheaper route proposed by the Junior Engineer, GSS, Bavatra, as detailed in Annexure 8.

Facts:

In this case, the petitioner sought the installation of an electricity connection for Respondent No. 4, Shri Super Foods. The Public Works Department (PWD) issued a letter dated August 12, 2022, affirming its acceptance of the installation of an electricity pole at Village Bavatra. Annexure R/1 served as the technical and administrative sanction for the proposed electricity route, which was designed to pass through the highway while prioritizing safety considerations for the local residents.

Judgment:
Upon a thorough review of the case, including the arguments presented by both parties and the submissions by the respondent’s counsel, the Court made several key observations. Firstly, it noted that the respondents had successfully completed 60% of the pole installation process, as confirmed by the technical and administrative sanction dated June 30, 2023. Secondly, the proposed route for the electricity line traversed through the highway, specifically on government-owned land. Additionally, the Court acknowledged the existence of a No Objection Certificate (NOC) issued by the PWD, endorsing the use of the highway route. Furthermore, the objections raised by the petitioner were found to be adequately addressed within the records presented by the respondent.

In light of these considerations, the Court arrived at the decision to dismiss the present writ petition. Consequently, all pending applications related to the case were duly disposed of.
