Delhi High Court seeks Central and Delhi governments’ response on plea for proper maintenance of public toilets

The Delhi High court passed a judgement on 17th   February, 2023. This was seen in the case of   Jan Seva Welfare Society (Reg.) v. Union o f India and Ors DHC/2023and he case was presided over by Hon’ble  Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad 

FACTS OF THECASE:

The petition filed by a registered society named Janseva Welfare Society through advocate Bankey Bihari, argued that the general public in Delhi faces lots of troubles due to poor maintenance of public toilets and lack of hygiene.

 “Thus, non-facilitation of clean and hygienic public urinals is a clear violation of the right to life and personal liberty of the public at large as promised under Article 21, Part III of the Constitution of India. Moreover, through Article 4 7 of the Constitution of India, the State is empowered as well as burdened with the task of improving public health facilities for the common people and public urinals are central to this endeavour,” the PIL said.

NOTICE OF THE COURT

The Delhi High Court on Friday issued notice to Central and Delhi governments as well as Municipal Corporation of Delhi (MCD) on a public interest Litigation (PIL) petition demanding proper maintenance of the city’s public toilets.

A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad ordered the authorities to ensure that these conveniences are cleaned and a status report filed on the same.The case will now be heard on May 23.
