Decided on: 6th July, 2023
PUBLIC INTEREST LITIGATION (PIL) No. – 1407 of 2023
CORAM: Hon’ble Pritinker Diwaker,Chief Justice Hon’ble Ashutosh Srivastava,J.
Introduction.
The Allahabad High Court on Thursday gave the Union of India, the Ministry of Information and Broadcasting, the Central Board of Film Certification, and Al Jazeera Media Network Private Ltd. an additional 4 weeks to file their counter affidavit in a PIL complaint contesting the broadcast/release of the documentary film “India….Who lit the Fuse?” in India.
Analysis.
Social activist Sudhir Kumar has filed a legal challenge against the video, which was made by an international news network with headquarters in Qatar, on the grounds that its broadcast could stoke unrest among the populace and jeopardise national security.
After hearing the PIL argument on June 14, the High Court issued a restraining order prohibiting Al Jazeera from airing, distributing, or disseminating the disputed film in India due to the potential for “evil consequences.”
The bench further directed the respective authorities to take the necessary steps to make sure that the disputed film is not broadcasted till the time it is examined and reviewed and necessary certification is obtained.
