DENIAL OF CHILDCARE LEAVE HELD AS VIOLATION OF LAW

ABSTRACT

When an employee is not given childcare leave even if they are eligible it goes against the service rules and is unfair to working parents especially mothers this type of denial is now seen as a violation of the law and the rights of the employee

 

INTRODUCTION

On fifteenth May two thousand twenty five a woman employee working in a government office was denied childcare leave even though she had a young child and had applied properly the matter was taken to court and it was said that not giving such leave without a valid reason is wrong and against the rules

The woman had asked for childcare leave because her child needed her attention and care but her request was turned down without any real reason she felt that this was not fair and she decided to challenge it the case went to the Calcutta High Court where the judge looked into the matter seriously

 

The court said that childcare leave is not a special favour it is a right given to certain employees under the law and service rules if a person qualifies for it and follows the correct process then it must be granted denying it without explanation is against fairness and justice

 

The court also said that taking care of a child is an important responsibility and the employer must understand this by refusing the leave the department created unnecessary trouble for the employee and harmed the well being of her family

 

The judgment also reminded all government offices and departments to strictly follow the rules and not to act in a careless or insensitive way towards such leave requests the judge said that being a mother and a worker at the same time is not easy and offices should help not make it harder

 

This case is now an example for others it shows that childcare leave is important and must be respected it is a part of creating a fair and supportive workplace

 

CONCLUSION

Denying childcare leave without a strong reason is not just wrong but also a violation of the rules and the law the judgment gives hope to working women who face similar problems and reminds employers to respect the balance between job and family
