Introduction

The High Court of Delhi at New Delhi Conducted the government of Delhi to establish within four weeks its motion regarding the institution of a specific training academy for public prosecutors

Chief Justice Satish Chandra Sharma and Justice Tushar Rao Gedela in a division bench directed that the public prosecutors shoulder weighty responsibilities in the discharge of their duties and directed the Delhi Government to file an affidavit outlining the steps taken by it.

Facts of the case

A bunch of petition was been heard by the bench together with a suo moto case registered in 2009 as a letter petition was been moved to focus on the issue of undertrials languishing in jail from 5 to 12 years without a trial.

Mr. Santosh Kr. Tripathi stated before the court that the newly appointed Public Prosecutor(s) have been provided with adequate training at the Delhi Judicial Academy; and that a proposal for a specialised academy is pending consideration with the GNCTD.

Mr. Rajeev K. Virman has submitted that the said training was provided by the GNCTD on an ad hoc basis and has reiterated the need for a structured training program for the newly appointed Public Prosecutor(s).

Analysis of the court

It is been observed by the court that public prosecutor(s) shoulder weighty responsibilities in the discharge of their duties. Accordingly, the GNCTD is directed to finalize its proposal for the establishment of a specialized training academy for public prosecutor(s) within 4 weeks form today and file an affidavit outlining the steps taken in furtherance of the same before the next date of hearing.

Furthermore, it has been brought to our notice that no affidavit has been filed by GNCTD in compliance with the order Accordingly, they are granted an additional further two week to comply with the aforesaid order
