Introduction
The Telangana High Court directed the Bar Council of India to examine the representation of the petitioner dated 18-08-2023 within a period of two (2) weeks from today and communicate the decision thereon to the petitioner. A singe judge bench Hon’ble Sri Justice C.V. BHASKAR REDDY passed the order.
Facts of the Case:
The petitioner, Rajasekhar Simma, who is a student at Osmania University LLB 3rd year Degree Course. He appeared in the final year exams which were held on 14-08-2023.
The petitioner’s grievance is that being in the final year as per the judgement of the Hon’ble Supreme Court in Bar Council India vs. Bonni FOI Law College and others, they are not being provided the opportunity to appear for the AIBE exam based on the recent notification for timetable issued by the Bar Council of India dated 16-08-2023.
The Petitioner has therefore filed a writ of mandamus under Article 226 of the Constitution in this regard asking the Bar Council of India to accept the applications of final year LLB students for the AIBE-18 examination.
Court’s Analysis and Decision:
In view of the same, the Respondent No. 1 is directed to examine the representation of the petitioner dated 18.08.2023 duly taking note of the observations made by the Hon’ble Supreme Court in para 38 of the decision in Bar Council of India us. Bonni FOI Law College and. others, within a period of two (2) weeks from today and communicate the decision thereon to the petitioner.
