Introduction
The Kerala High Court issued an order directing the Special Judge of the Vigilance Court to review the investigative agency’s final report within two months. The Court observed that the police had filed a final report under Section 173 CrPC indicating that “further action dropped” against Advocate Saiby Jose Kidangaoor following the conclusion of their probe.
Facts of the Case
Attorney Saiby was charged with taking money from clients with the intention of buying off High Court justices. Using Section 420 of the Indian Penal Code and Section 7(1) of the Prevention of Corruption Act, 1988, the Ernakulam Central Police Station filed a formal complaint against Advocate Saiby. In accordance with Section 173 CrPC, the Court today observed that the police had concluded their investigation and turned in their final report.
Courts analysis and decision
In response to the FIR, Advocate Saiby filed a request with the High Court to halt any more actions taken against him under Crime No. 362/2023, which is registered with the Ernakulam Central Police Station. The Public Prosecutor notified the Court that, in its final report, the investigative agency had decided not to press charges against Advocate Saiby and to take any further action against him.
