PUBLIC INTEREST LITIGATION (PIL) No. – 1412 of 2023

Coram: Hon’ble Pritinker Diwaker,Chief Justice Hon’ble Ashutosh Srivastava,J.

Introduction.

The Allahabad High Court ruled that whether or not transgender people live in a certain location, public restrooms for men and women should be built alongside those for transgender people, regardless of the population density of that area.

Analysis.

The bench sat to hear a PIL that had been submitted by students from several law schools. They stated that they had formed a fact-finding commission to determine the challenges non-binary residents of Allahabad faced.

The Court emphasised that when building restrooms for transgender people, population density should not be taken into account. It stated that bathrooms should be built in all public areas beside bathrooms for people who identify as binary.
