Case Title: Swami Ramdev @ Baba Ramdev @ Ramkrishna Yadav vs. State Of Rajasthan & Anr.

Date of Decision: 11/09/2023

S.B. Criminal Misc (Pet.) No. 1489/2023

Presiding Judge: Hon’ble JUSTICE KULDEEP MATHUR

Intro:

The Rajasthan High Court has directed Yoga Guru Baba Ramdev to appear for police interrogation on October 12, 2023, in connection with an FIR lodged against him over alleged anti-Muslim remarks made at a gathering of seers in Rajasthan’s Barmer district earlier this year. The court also extended the interim order granting him protection from arrest until October 16, 2023.

Facts:

The FIR against Baba Ramdev was filed based on a complaint by a Barmer resident, Pathai Khan, who took offense at the Yoga Guru’s comments during a sant samagam (religious gathering) held at Taratar math on February 2. In the FIR, it was alleged that Baba Ramdev compared Hinduism with Islam and Christianity, suggesting that both religions were focused on conversion, while Hinduism encouraged its followers to do good.

A video of these purported remarks surfaced on social media, in which Baba Ramdev was shown allegedly accusing Muslims of engaging in “terrorist acts” and “abducting Hindu women.” Subsequently, he was booked under Sections 153 (promoting enmity between different groups on religious grounds), 295A (deliberate acts intended to outrage religious feelings), and 298 (uttering words with intent to wound religious feelings) of the Indian Penal Code.

Judgment:

The Rajasthan High Court, presided over by Justice Kuldeep Mathur, has ordered Baba Ramdev to appear for police interrogation on October 12, 2023, regarding the FIR filed against him. Additionally, the court extended the operation of an interim order, initially granted in his favor in April this year, which had placed a stay on his arrest. The case will be further heard on October 16, 2023, as the legal proceedings unfold. This development highlights the ongoing legal scrutiny of the Yoga Guru’s statements and their potential legal consequences.
