INTRODUCTION
India is about to experience its first major shift in digital gaming regulations. The government has issued the Promotion and Regulation of Online Gaming (PROG) Rules, 2026 which will begin operations on 1st May, 2026. The rules establish operational procedures for the Promotion and Regulation of Online Gaming Act, 2025 (PROG Act) which was passed by the Parliament in August, 2025. The framework establishes legal boundaries which differentiate between allowed online games e-sports and social games and illegal money games which use real money betting. India’s expanding online gaming market will achieve organized governance through its dedicated regulators who establish user safety standards and registration rules and grievance redressal systems. The digital gaming industry in India will receive its first major assessment through these regulations which will establish new requirements for monitoring and enforcement.
BACKGROUND
India’s online gaming industry has experienced rapid development during the last ten years which has brought in millions of gamers and received substantial international investment. The industry existed within a disjointed legal framework because different states implemented their own definitions of gambling and gaming activities. The legal situation created difficulties for service providers and users and financial institutions to understand.
The Parliament passed the PROG Act, 2025 to create a complete national legal system which addresses the existing legal void. The new regulations established through the Act now enable its implementation. The government implements a “regulatory-light” strategy which allows online social games to operate without needing their developers to complete compulsory registration and classification procedures. The government will implement stricter compliance requirements for e-sports and specific social games which need financial transactions because they pose risks to all users including children.
ANALYSIS
- Establishment of the Online Gaming Authority of India
The Online Gaming Authority of India establishes itself as a digital-first regulatory body through its operations base which it maintains at the Ministry of Electronics and IT. The organization operates under the leadership of MeitY Additional Secretary who oversees a team that includes members from Home Finance Sports Law and Information Broadcasting. The authority needs members from various fields because online gaming regulation requires their specialized knowledge. The authority possesses the right to create a list of illegal money games, develop operational guidelines, and establish partnerships with financial institutions and police departments.
- The Determination Test: Classifying Games
The rules contain their most important element through the implementation of an objective “Determination test” that establishes whether a game constitutes a prohibited money game. The authorities can activate the test through three different mechanisms which include their independent actions and e-sport service provider requests and government declarations of social game categories. Key factors examined include payment of fees, expectation of monetary winnings, revenue models, and monetisation of in-game assets. The complete determination procedure requires 90 days to complete which helps to deliver essential regulatory stability for businesses operating in the sector.
- Registration and Certification of E-Sports
All e-sport service providers must register under the new framework because registration has become a compulsory requirement. The Centre has established specific social game categories that require registration based on their associated risk levels. Importantly, online money games are strictly ineligible to be classified as e-sports. The registered providers receive a digital Certificate of Registration which remains valid for 10 years.
CONCLUSION
The government has created a complete regulatory system through its establishment of a specific regulatory body and its introduction of a neutral classification method and its requirement that e-sports athletes must register and its dedication to protecting user security which forms the main element of its regulatory system. The industry supports these new rules but it needs more information about how e-sports players will handle their finances and how banks will treat them differently from other customers. The framework establishes a practical approach which enables industry expansion while ensuring user safety and stakeholders from all industry sectors will monitor its execution which begins on 1st of May, 2026.
