Politician Srikant Tyagi denied relief. ‘Person choosing violence can’t plead that State should take measures to protect his life’ states the Court.

Title: Srikant Tyagi and another vs. Union of India and 4 Others

Decided on: 4th July, 2023

CORAM: Hon’ble Mahesh Chandra Tripathi,J. Hon’ble Prashant Kumar,J.

Introduction.

According to a recent ruling by the Allahabad High Court, a person who has chosen violence and does not respect human life has no right to demand that the government take extra precautions to protect him from his opponents.

Analysis.

It was stated, the petitioner has a legitimate concern that infamous criminals may target him and his family members with the goal to kill them, but the respondents are failing to adequately protect them.

The Court also cited the Allahabad High Court’s ruling in Nutan Thakur v. State of U.P. & Ors. (2014), which held that any security provided by the State to individuals engaged in criminal activity should be removed right away and that security for those individuals should then be reviewed by the State after an objective threat assessment is taken into account.
