Facts of the Case
The writ petition being heard is about the petitioner claiming the validity certificate of the ‘Koli Mahadev’ scheduled tribe. It was argued that the Scrutiny Committee has rightly rejected the caste claim considering the contrary entries and manipulation of the school record of the relatives of the petitioner. The affinity test was recorded against the petitioner. The validity certificates were being tried to be obtained by suppression of material facts.
Court Analysis and Judgement:
The court was of the considered view that the petitioner is entitled to validity certificate on certain condition. This is because both his father and his sister had validity certificate. The impugned judgment and order was quashed and set aside, and certificate was granted to him.
