INTRODUCTION
The Supreme Court of India has given a strong verdict that no violence or threats will be tolerated against medical practitioners, noting that medical professionals cannot exercise their independent judgment if they have to worry about violence. The court ruled that creating the necessary conditions for ensuring safety for medical personnel is a fundamental right that has nothing personal to it; it is necessary.
BACKGROUND
The observations were issued during the proceedings of an appeal in which the Supreme Court was seized of an appeal against the order of the Bombay High Court granting bail to a municipal corporator and three others accused of assaulting and abusing three doctors, out of whom one was a lady doctor, in a municipal hospital in Maharashtra. In the wake of the harassment, the traumatised doctors resigned from their jobs. The High Court ordered a speedy trial while granting bail to the accused, which caused the State to approach the Supreme Court. The State contended that the High Court failed to take into account fully the overall effects of such violence on the operations of the medical profession.
