FACT:

Upon examining the paper document, it was revealed that on June 30, 2020, a report was received at Barauda Police Station in Sonipat District. The report stated that two uniformed police officers were discovered deceased alongside Jind-Gohana Road, near Hariyali Park in Butana Village. Adjacent to them was a motorcycle with license plate HR-10-Y-1465. In response to this information relayed by ASI Sanjay, the Officer-in-Charge of Barauda Police Station arrived at the scene. The deceased individuals were identified as Constable Ravinder (Badge No. 564) and SPO Kaptan (Badge No. 213). These officers had been on duty using the official vehicle with license plate HR-10-Y-1465. Their lifeless bodies were situated at the roadside, covered in blood, and they had been fatally wounded with a sharp-edged weapon. ASI Sanjay’s statement led to the initiation of a First Information Report (FIR).

COURT ANALYSIS AND DECISION:

When examining the case in detail, it becomes evident that the case relies predominantly on indirect evidence, particularly the statements of disclosure. The petitioner ‘S’ has been apprehended based on information provided by co-accused Sandeep. The prosecution does not claim that she utilized a knife or any weapon to perpetrate the murder of the two police officials. The sole accusation, which is derived from the disclosure statement, suggests that she was involved in physically assaulting the victims and was present during the crime. The petitioner has been held in custody since July 3, 2020, which equates to over 3 years and 1 month. Given the potential duration of the trial, it can be concluded that the case may require a substantial period to reach a resolution.
