The Madras High Court passed an judgement on 26th of April, 2023 in which it directed the Sub Registrar to conduct enquiry layout that has been formed without approval in Koothapakkam Village, Cuddalore Taluk, Cuddalore District. This was seen in the case of N. Panneerselvam and Anr. v. The Sub-Registrar and Ors. (WP No.12978 of 2023) and the case was presided over by The Honourable Mr. Justice S.M. Subramaniam
FACTS OF THE CASE:
The petitioner filed a writ petition seeking an issue of a Writ of Certiorarified Mandamus calling for the records and quash the impugned refusal order passed by first respondent. The petitioners state that a layout has been formed at ‘PRS Nagar’, Koothapakkam Village, Cuddalore Taluk, Cuddalore District without the required approval. Relevant documents had been submitted.
The Sub Registrar rejected the same stating that the second respondent had already filed an objection for registration of any documents with respect to the property. Hence this petition.
JUDGEMENT:
The learned single judge after listening to the contentions, directed the Sub Registrar has to conduct an enquiry with reference to the documents presented by the petitioners and thereafter take a decision on merits and in accordance with law. The petition was hence disposed.
