The High Court of Kerala passed a judgment on  11 January, 2023 ,stating it is apodictic that distribution of the SRBF to the persons eligible would cause no prejudice even to the society; and is not opposed by the government either. It was stated in the case of Kerala State Co-Operative Bank Employees Union (BEFI) &ors. vs The State Of Kerala (WP(C) NO. 26265 OF 2019) which was passed by the single judge bench of Justice Devan Ramachandran

FACTS OF THE CASE:

Certain Unions of employees and the employees of the ‘Kerala State Co-operative Agricultural Rural Development Bank’ (‘Society’, for short), have approached the Court impugning the orders of Registrar of Co-operative Societies and the Government, directing that the ‘Staff Retirement Benefits Fund’ be forthwith terminated, since it goes contrary to the provisions of the Kerala Co-operative Societies Act.

 

JUDGEMENT OF THE CASE

The court made it clear that continuance of the ‘SRBF’ will only be as per the decision to be taken by the Government in future; and they shall, therefore, hear the petitioners, as also any other person who may be interested, and take a final decision in this regard within a period of six months.
