The Bombay High Court permits a death row inmate who was convicted of killing his mother to attend his daughter’s wedding.

The Bombay High Court permitted a death row inmate who killed his mother and dismembered her body to attend his daughter’s wedding on Monday. There will always be an escort party in civil attire at the locations. In the case of Sunil Rama Kuchkoravi v. State of Maharashtra ( Interim Application No. 673 of 2023 in Criminal Confirmation Case No. 1 of 2021), Justice AS Gadkari and Justice PD Naik, decided upon the order. 

FACTS OF THE CASE : 

In 2021, Additional Sessions Judge Mahesh Jadhav of Kolhapur District found the man guilty of murdering his mother, dismembering her body, and preparing to cook the parts under section 302 of the IPC. The trial court sentenced him to death, noting that his deeds were wicked and without remorse and that they qualified as one of the “rarest or unusual” cases.

The High Court is currently hearing the matter regarding the confirmation of his death sentence.

For his daughter’s wedding on February 24, 2023 in Kolhapur, the offender requested a weeklong interim release from February 22, 2023 to February 28, 2023.

He said that he has been detained since August 28, 2017, and that he has never been granted bail, parole, or a furlough. Also, he is from a lower socioeconomic class and cannot afford the escort fees.

JUDGEMENT : 

The court ruled that the applicant comes from a lower socioeconomic class, and it ordered the government to waive escort fees for the person who would accompany him to the wedding.

His presence is required for carrying out religious ceremonies, a division bench of Justices A. S. Gadkari and P. D. Naik noted the following : 

“There is no question that the applicant must be present on the day of his daughter’s wedding in order to conduct religious rites. We are inclined to release the applicant from jail on February 23, 24, and 25, 2023, between the hours of 9.00 am and 6:00 p.m., so that they can attend their wedding and any associated religious rites.
