Vs.

State of Haryana

2023:PHHC:105975

Coram HON’BLE MR. JUSTICE ALOK JAIN

DATE: 17.08.2023

FACTS:

During the initial court session, it was observed that the case was peculiar due to the circumstances involving the first petitioner, a married woman, who was involved in a cohabiting arrangement with the second petitioner, an unmarried individual. The Court remarked that the narrative presented by the couple lacked credibility and appeared to be a collection of untruths. Furthermore, the Court pointed out that the involved parties had formalized their cohabitation through a “live-in relationship deed” on July 17 in Rajasthan, which is the woman’s matrimonial residence. She then lodged a complaint with the Superintendent of Police (SP) in Hisar. In her submission, she detailed that a week prior, she had revealed her relationship to her parents, which resulted in physical abuse from her family. Subsequently, her husband also subjected her to violence and confined her to a room.

COURT ANALYSIS AND DECISION:

From the initial hearing, it was explicitly communicated that if it’s determined that the petitioners are not under any threat, they would be required to cover expenses of a minimum of Rs. 50,000. Nonetheless, during the current session, the legal representative of the petitioners has requested the withdrawal of the current plea and a reduction in the imposed cost. Consequently, the present petition is terminated, provided that the petitioners jointly submit a payment of Rs. 10,000 within a month
