Plea before Bombay High Court against strike by Maharashtra government employees for old pension scheme: bombay High Court

Balaappa_Eknath_Sadavarte_And_vs_The_State_Of_Maharashtra_Through_on_6_December_2022The Bombay High Court passed a order on 13 March, 2023.This was seen in the case of Gunratan Sadavarte v. State of Maharashtra & Ors. 906 OF 2022 and the case was presided over by Hon’ble Justice SV Gangapurwala and Justice Sandeep Marne .

 

 

FACTS OF THE CASE:

In this case the petitioner i.e. A lawyer approached the court regarding indefinate strike by government employess who are demanding the implementation of the old pension scheme.

 

OREDER OF THE CASE:

The court held, However, without looking into the ‘positive/ affirmative steps’ taken by the government, the employees proceeded to go on an ‘illegal strike’, it was submitted.

“Due to this, the services in hospitals, educational institutes, government establishments, tax offices and even the district collector offices have completely shut”, the plea said.

Sadavarte also claimed that the strike is against the provisions of the Maharashtra Essential Services Maintenance Act, 2023 (MESMA).

In view of this, Sadavarte approached the High Court seeking directions to the employees to withdraw their plea.
