Patna High Court asked the respondent to consider the petitioner’s request to put her on   her   post   under   Rural Development   Department.

This case was filled by Kumari Kiran Sinha, W/o Dharmendra Kumar, resident of Village-Gautam Nagar Janta Road, P.S.-Gardanibagh, District-Patna against The State of Bihar. The Judgment in Kumari Kiran Sinha v. The State of Bihar (CWJC No.6745 of 2022) was filled by HONOURABLE MR. JUSTICE P. B. BAJANTHRI.

FACTS OF THE CASE:
This case was filled under Article 226 of the Constitution of India, 1950. Under this petition the petitioner seeks the court to order to quash the memo no. 225 dated 31.01.2022 issued by the Joint Secretary, Directorate of Economic and Statistics, so far the Office order no. 10/2021-39 of the petitioner is concerned whereby she has been transferred and posted as Block Statistical Officer, Block- Chausa, Madhepura, withdrawing her deputation in Rural Development Department. Further, she seeks the court to issue the writ in the nature of Mandamus commanding upon the respondents to retain the petitioner on her post under Rural Development Department where she was posted against a vacant post; or the respondents may be directed to post the petitioner in any other offices in Patna considering 14.03.2022.

JUDGEMENT:
The court in view of the facts and arguments of the court observed and ordered the respondent to consider the petitioner’s representation read with transfer policy of the State, if any, within a period of one month from the date of receipt of this order.
