No Disapproval NOC for Meat Shop on the Ground of Unauthorised Sale of Meet : Allahabad High Court

Introduction:

Justice Vivek Chaudhary and Justice Manish Kumar assisted Superintendent of Police , Ambedkar Nagar to consider and pass a fresh order on Mohd. Shakeel /Petitioner for granting a NOC to open a Meat shop.

 

Some reports were given by the police so the petitioner application was rejected further report also mentioned that the meat shop was in the mixed population 50 meters from Mosque and 150 meters from Temple, challenging the rejection of his application he moved the High Court.

Court Analysis:

 

Bench noticed that the location of the shop is the concern , the court noticed that 3 more shops had a NOC  and in the Affidavit of state government and court stated that in the radius of 50 meters of the meet shop there was no religious place. The Allahabad High Court has observed that the probability of unauthorized sale of meat is no ground to refuse a ‘no objection certificate’ (NOC) for retail meat shop .

With the this point of view the writ plea was allowed.
