Facts of the case:
The instant misc. petition under Section 482 Cr.P.C. has been filed by the petitioner against the order dated 06.04.2021 passed by learned Special Metropolitan Magistrate (N.I. Act Cases) No.7, Jodhpur Metropolitan, in Criminal Case No.11307/2018 whereby learned trial Court has initiated proceedings against the petitioner under Section 446 Cr.P.C. and issued arrest warrant against the petitioner.
Petitioner is a lady and she is ready to appear before the trial Court. Therefore, I deem it appropriate that the arrest warrant issued against the petitioner by the trial court, be converted into bailable warrant of Rs.30,000/-. The petitioner is directed to appear before the trial within a period of fifteen days from today and submits the bail bonds. Upon submitting the bail bonds, the trial court shall release the petitioner on bail. If the petitioner fails to appear before the trial Court within the stipulated period, then the trial court shall issue arrest warrant against her. It is also made it clear that if the petitioner does not deposits the amount of proceedings under Sections 446 Cr.P.C., then the trial Court shall also issue arrest warrant against her.
Judgement:
The misc. petition is disposed of accordingly. Stay petition is also disposed of.
