This case was filled by Meera Chaturwedi, Female, aged about 42 years, Wife of Suresh Chandra Chaturvedi, proprietor of M/S Shubham Chawal Udyog Rice Mill, resident of Village – Ramgarh, P.S. Ramgarh, District – Kaimur (Bhabhua) against the State of Bihar. The Judgment in Meera Chaturwedi Vs. The State of Bihar (Citation: CWJC No.14 of 2021) was served by HONOURABLE MR. JUSTICE RAJAN GUPTA and HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH.
FACTS OF THE CASE:
In this case the petitioner has challenged the public notice which appeared in the newspaper ‘Hindustan’ dated 8th July, 2020 which was issued by Bihar State Food and Civil Supplies Corporation Limited (BSFC). This notice proposed to put on auction sale the respective property pledged by one defaulter named Millers including that of the petitioner in light of orders dated 28.02.2017 and 13.08.2018 passed by the Hon’ble Supreme Court in SLP(Crl.) No. 1779 of 2016 and SLP(Crl.) No. 9196 of 2017 respectively
However, the respondents have not put the pledged property on auction sale which according to the Notice was 28th July, 2020.
JUDGEMENT
The court after going through the arguments disposed of the petition and held that since the auction sale has not taken place till date. The impugned notice has thus outlived its life and hence the Court need not adjudicate upon the same.
