The Andhra Pradesh High Court orders to stop the establishment of 11 Petroleum Outlets by observing the PIL filed to seeking the investigation of CBI and SIT in illegal sale

Introduction

The present petition filed by the petitioner under the provision of f article 226 of the Indian Constitution, and prayed the Hon’ble High Court to direct the order in the nature of writ of Mandamus for the investigation trough CBI and SIT in the illegal sale of petroleum product in the territory of the state of AP, which is meant to sale in the UT of Yanam of the state of Pondechery, and also prayed to the Hon’ble Court to punish the real culprit. On observing the petition and allegation made by the petitioner through the present petition the Hon’ble High Court orders to stop the establishment of 11 Petroleum outlets in the territory of Yanam.

Facts of the case

The alleged in his petition that the petroleum products has been purchased in Yanam by the corporation from the bulk sale points within the state of AP and instead off selling into the Yanum they are selling the products within the near-by districts under the territory of state of AP, due to which a great loss has been facing the revenue of state and public exchequer.

Court’s Observation
Petition under Section 151 of CPC has filled in the support of the petition filed before and prayed before the High Court to direct the respondent Director General of Police AP, and Commissioner of civil supplies department, State of A.P. and also prayed to direct the respondent Petroleum Corporation not to another steps in pursuant to the notification date 28.06.2023.pending disposal of WP (PIL) of 154 OF 2023, on the file of High Court. The Hon’ le High Court observed that the respondent authorities took no cognizance in the present matter to stop the illegal trades of petroleum products within the territory of State of AP. While the population of the Yanam is only 69.375. 10 outlets of petroleum products are there and the corporations are proposing to establish 11 more outlets, while ignoring the facts and circumstances of illegal sale of the products, the Court orders to stop the establishment of outlets of petroleum products in the territory of Yanam and learned counsel for the petitioner is permitted to issue personal notice to the respondents by RPAD and post after 4 weeks.
