Introduction.
The Allahabad High Court recently instructed the State Government to take decisive measures to alter the wage policy for such jail inmates after taking serious note of the appalling conditions of jails throughout the state of Uttar Pradesh and the predicament of convicts and undertrials incarcerated in such prisons.
Analysis.
In order to ensure conditions (inside jail faculties) for a dignified human existence inside the jails, the Court reminded the state government, emphasising that inmates are also a part of society, that failing to do so could prevent the justice delivery system from delivering justice with dignity.
The bench of Chief Justice Pritinker Diwaker and Justice Saumitra Dayal Singh also bemoaned the State Government officials’ callous attitude towards the predicament of those who are still awaiting trial and those who have been convicted. It further instructed the extra IG (prisons), secretary, and finance to attend the subsequent hearing in person.
The Court stated that, in light of the killings occurring within prisons, nothing would be “more shocking” to the Court or the justice delivery system (as a whole) than the killing of any defendant or convict while in the Court’s care.
